Annual Report of Beijing Municipal Bureau of Justice on Government Information Disclosure in 2020
This report is compiled in accordance with Article 50 of the Regulations of People’s Republic of China (PRC) Municipality on the Openness of Government Information (hereinafter referred to as the Regulations on the Openness of Government Information).
I. General situation
In 2020, under the guidance of Socialism with Chinese characteristics Thought of the Supreme Leader in the New Era, the Bureau thoroughly implemented the spirit of the 19th National Congress of the Communist Party of China and the 2nd, 3rd and 4th Plenary Sessions of the 19th National Congress, made efforts to strengthen publicity, interpretation, release and interaction, actively built platforms such as government websites and new media for government affairs, and comprehensively improved the quality and effectiveness of publicity in accordance with the requirements of the Regulations on the Openness of Government Information, and combined with the actual work.
(A) to further strengthen the organizational guarantee of government information disclosure.
In order to better carry out the disclosure of government information and government affairs, enable the general public to better understand the judicial administrative work, provide faster and more convenient legal services, implement relevant work, and avoid unclear responsibilities and buck passing, our bureau further strengthens the team management of government information disclosure, and requires all offices to clearly define the department (deputy) level responsible for government information and government affairs disclosure in combination with the tasks corresponding to the Complete List of Government Information Disclosure of Beijing Municipal Bureau of Justice.
(2) Solidly promote active publicity.
1. Actively promote the disclosure of office information. Not only the regular office hours are made public in the portal "Introduction to the Bureau of Justice", but also the "Contact Us" column is specially added at the bottom of the homepage of the portal to further refine the disclosure of office hours, and all the telephone numbers of comprehensive consultation (information disclosure) of the Municipal Bureau of Justice, administrative reconsideration of administrative examination and approval (letters and visits from the administrative reconsideration reception room of the Beijing Municipal People’s Government), public legal service hotline, supervision telephone number and specific consultation telephone numbers and reception hours of various offices are made public.
2. Dynamically adjust the full list of government information disclosure.
In order to further promote the openness of government affairs in our bureau and improve the standardization level of government affairs openness, according to the Notice of the Office of the Leading Group for Government Affairs Openness of Beijing Municipality on Dynamically Adjusting the Whole List of Government Affairs Openness in this Municipality, the "specific responsibilities" and "business matters" of the existing whole list of government affairs openness are sorted out, and the whole list is increased or decreased according to the principle of "only increasing without decreasing" to ensure full coverage of responsibilities and no omission of matters. For the added responsibilities, the disclosure attributes such as voluntary disclosure, disclosure according to application and non-disclosure shall be defined item by item. If it belongs to the scope of voluntary disclosure, the attribute basis, content standard, disclosure subject, disclosure time limit and disclosure form shall be defined; Belonging to the scope of non-disclosure, the legal reasons for non-disclosure shall be clarified in accordance with the Regulations. If the disclosure of government information is changed from application to active disclosure, the missing information in the original application disclosure list shall be supplemented according to the elements of active disclosure list. This time, 21 items have been adjusted, and the adjusted List of Government Information Disclosure of Beijing Municipal Bureau of Justice is still 80 items, which has been made public on the portal website as required.
3. Do a good job in pre-disclosure of administrative decisions.
Our bureau conscientiously implements the system of pre-disclosure of major administrative decisions, and will pay high attention to major decision-making matters involving public interests and public rights and interests, except those that should be kept confidential according to law. For example, the formulation basis, drafting instructions and collection cycle of six draft administrative decisions, such as Beijing 2021 Government Regulation Legislative Project, Beijing Judicial Appraisal Management Regulations (draft for comments), Beijing Judicial Administrative System Classification and Penalty Discretion Benchmark Catalogue, and Beijing Judicial Administrative Organs Classification and Penalty Discretion Benchmark Catalogue (revised draft for comments), were collected on the portal website of our bureau. And within 30 days after the end of the collection work, the main opinions and the number of opinions adopted will be actively disclosed to the public.
4. Conscientiously implement the policy interpretation
In 2020, the Bureau issued the Implementation Measures for the Pilot Work of the Evaluation System and Evaluation Mechanism for Lawyers’ Professional Level (Trial) and the Management Measures for the Registration of Business Institutions Established by Overseas Arbitration Institutions in the China (Beijing) Pilot Free Trade Zone. These two normative documents were published in the "Policies and Regulations" section of the Bureau’s portal website, and at the same time, the policy interpretation documents were synchronized with the interpretation plan, interpretation materials, and the background basis and deployment of relevant documents were discussed. In the policy interpretation column of the portal website, our bureau released six policy interpretations, including Five Questions to Show You the Management Regulations of Judicial Appraisal in Beijing and Interpretation of the Legislative Work Plan of the Municipal Government in 2020 by the Beijing Municipal Bureau of Justice. Director Li Fuying earnestly performed his duty as the "first interpreter", carefully interpreted the main contents of the Civil Code of People’s Republic of China (PRC) for the overall comrades, and published the "Implementation Opinions on Strengthening the Study and Publicity of the Civil Code of People’s Republic of China (PRC)" on the portal website. The Bureau also interpreted the "Foreign Language Signs in Public Places in Beijing" in the form of pictures and texts, which improved the practicability of policy interpretation.
5. Further promote the disclosure of government information in key areas. Important government information, such as Report of Beijing Municipal Bureau of Justice on the Construction of a Government under the Rule of Law in 2019, Department Final Accounts of Beijing Municipal Bureau of Justice in 2019, Budget Information of Beijing Municipal Bureau of Justice in 2020, Work Summary of Beijing Municipal Bureau of Justice in the First Half of 2020, and the progress of Beijing Municipal Bureau of Justice’s performance tasks in 2020, were published on the website of our bureau, so as to achieve "should be made public, as far as possible". In addition, relying on the portal website, Beijing Legal Service Network, Jingsi Guanlan WeChat WeChat official account, Beijing Judicial Sina Weibo, Beijing Judicial No.1, Beijing Judicial No.1 and Beijing Legal Weibo WeChat propaganda matrix, our bureau has published government information related to popularizing the law and governing according to law, and widely publicized our bureau’s public legal services around ensuring the overall situation of "six stabilities" and "six guarantees" to help enterprises benefit the people in spring. Issue notices on administrative reconsideration, administrative examination and approval, arbitration, annual inspection of lawyers and annual filing of law firms, selection of people’s jurors in 2020, and Beijing test area of national unified legal professional qualification examination in 2020, and timely publish information and work measures for epidemic prevention and control of returning to work and production, and respond to social concerns. According to statistics, in 2020, our bureau made 2719 pieces of government information public on the portal website.
(3) Handling government information according to the law and regulations, and making it public according to the application.
In 2020, our bureau accepted 129 applications for government information disclosure submitted by citizens, legal persons and other organizations, 7 of which were carried forward from the previous year, and 125 were completed, and 11 of which need to be transferred to next year. All matters disclosed according to the application shall be handled in accordance with the newly revised Regulations on the Openness of Government Information, and the reply opinions shall be strictly reviewed by the legal adviser of our bureau and legal opinions shall be issued.
(D) strictly control the source management of government information.
In order to ensure the legality and compliance of government information disclosure, our bureau requires that the government information be strictly audited, and all information released to the outside world can be released only after it is reviewed and signed by the deputy director in charge, the person in charge of the office, the leader in charge of the bureau and the director in charge of information disclosure in the office, so as to strengthen the government information management from the source and further standardize the government information disclosure.
(V) Continue to promote the platform construction.
In order to provide efficient and convenient integrated online government services to the general public, greatly improve the user experience and unify the overall style of the website, our bureau has revised the portal page after the website intensification, and made great efforts to serve the convenience of the people through the transformation and optimization of the website structure, column setting and visual effects, and integrated the three functions of "one netcom, one netcom, one netcom, one netcom, and one netcom" to fully consider the browsing habits of the general public.

Our bureau further strengthens the team management of government information disclosure, and requires all offices to combine the tasks corresponding to the "Full List of Government Information Disclosure of Beijing Municipal Bureau of Justice", clarify the department (deputy) level responsible person and specific staff who are responsible for government information and government affairs disclosure, establish a liaison working mechanism, assign responsibilities to people, and implement their posts. Combined with the intensive work of the website, we will provide professional training to the staff responsible for handling the interactive column matters between the government and the people in each office and for releasing special column information, and strengthen the management of government information disclosure through regular assessment and notification.

V. Existing Problems and Improvements
First, there is a phenomenon that government information is not made public in time, especially administrative licensing and administrative punishment decisions, which are often made public beyond the prescribed 7 working days. In order to avoid this situation, our bureau, in combination with the weekly report of the Municipal Economic and Information Bureau, urges the responsible offices to make timely rectification, and must be "open to the public".
